SMS Privacy Policy

TorqueTitan, LLC ("TorqueTitan," "we," "us," or "our") provides repair shop management software that enables two-way SMS messaging between automotive repair shops and their customers. This SMS Privacy Policy explains how we collect, use, store, and protect personal information in connection with our text messaging program.

1. Who We Are

TorqueTitan is the entity responsible for operating the SMS messaging infrastructure used by repair shops on our platform. When a repair shop's customer receives a text message related to their vehicle service, TorqueTitan sends that message on behalf of the shop. TorqueTitan is responsible for how messaging data is collected, stored, and used — not the individual repair shop.

2. Information We Collect

When you participate in our SMS program, we collect:

  • Your mobile phone number, as provided to a repair shop using TorqueTitan
  • Opt-in consent records, including the timestamp, source, and method of consent
  • Message delivery and status data (timestamps, delivery confirmation, and read receipts where available)
  • Content of messages sent to and received from you through our platform
  • Opt-out requests and the date they were received and honored

3. How We Use Your Information

We use information collected through our SMS program to:

  • Send appointment reminders, confirmations, and updates
  • Deliver repair status notifications (check-in, inspection, approval, completion)
  • Send payment requests and invoice notifications
  • Respond to your inbound messages and inquiries
  • Process and honor opt-out requests promptly
  • Maintain records of consent and communications as required by law
  • Troubleshoot delivery issues and improve platform reliability

4. How You Opt In

Your phone number is collected and your consent is obtained through an opt-in form presented by a repair shop using TorqueTitan — for example, a digital check-in form, appointment booking page, or another consent mechanism. The opt-in form includes a clear disclosure explaining that you are agreeing to receive text messages from TorqueTitan.

Consent is always explicit and voluntary. Providing your phone number and agreeing to receive messages is not a condition of receiving vehicle service.

5. Your Right to Opt Out

You may opt out of receiving SMS messages at any time by replying STOP to any message. After opting out:

  • We will send a one-time confirmation message acknowledging your opt-out
  • No further messages will be sent to your number, except as required by law
  • Your opt-out will be recorded and honored immediately

6. Data Sharing

TorqueTitan does not sell, rent, or share your phone number or SMS consent data with third parties for their marketing purposes.

We may share your information only with:

  • Twilio Inc., our SMS messaging provider, which transmits messages on our behalf over carrier networks
  • Mobile network operators and carriers, as necessary for message delivery
  • Cloud infrastructure providers who host our platform
  • Law enforcement or regulatory authorities, when required by applicable law

All service providers are contractually prohibited from using your data for any purpose other than delivering services to TorqueTitan.

7. Data Retention

We retain SMS-related data — including your phone number, consent records, and message logs — for as long as necessary to:

  • Maintain records of consent as required by applicable law, including the Telephone Consumer Protection Act (TCPA)
  • Resolve disputes and respond to complaints
  • Comply with legal holds or regulatory requirements

After the applicable retention period, we delete or de-identify your SMS data.

8. Security

We use industry-standard technical and organizational security measures to protect your information. Message data is encrypted in transit and at rest. Access to messaging data is restricted to authorized personnel. No security system is completely secure, and we cannot guarantee absolute security.

9. Your Privacy Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or obtain a portable copy of your personal data. To exercise any of these rights, contact us at support@torquetitan.ai.

10. Changes to This Policy

We may update this Policy from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of our messaging program after changes take effect constitutes acceptance of the updated Policy.
